Hostfurl Terms of Service

1. Definitions

In this document, unless the context requires otherwise:

Hostfurl, we, our or us means Hostfurl, a registered business in Australia with ABN 65 089 449 632.

The Customer, you or your means the customer who receives the Hostfurl Services and/or products your employees agents or any other person who uses your account, login or password, with or without your authorisation or the person applying for, or the holder of, a Domain Name Licence.

The Commencement Date of this agreement is the earlier of:

The Fees means the fees and charges payable for the service as determined by Hostfurl Domain Name means the domain name which is the subject of your application, and if successful, the Domain Name Licence. Registry Operator means the operator of the domain names registry for the Domain Name.

2. Hostfurl Services

Hostfurl will endeavour to provide service to The Customer as soon as possible after The Customer completes the relevant sign up forms and make payment for the service.

If Hostfurl is unable to provide the service The Customer has requested, The Customer will be informed within 5 working days and The Customer will receive a full refund for any charges paid for that service.

Customers should only use DNS names and not IP addresses. Hostfurl reserves the right to alter the configuration of the Hostfurl Network and to move customer services between servers at any time without notice.

Hostfurl will provide The Customer with Hostfurl Services in such a manner as Hostfurl deems fit.

2b. Hostfurl as acting registrar for purchase and transfer of domains

For selected domain name tlds (Top Level Domains), Hostfurl provides acting registrar services for purchase, transfer in, and transfer out of selected domain tlds. Hostfurl uses a registrar to provide these services, entering selected customer information for whois data or using a whois privacy feature if available and selected.

Hosting account services are separate from domain name registration services. If you cancel a Hosting account with Hostfurl and do not use a domain name registered through Hostfurl with another Hosting account with Hostfurl then you should take steps to either transfer the domain name or make sure renewal of the domain name with Hostfurl is turned off.

2c. Name servers at registrar level

By default Hostfurl enters ns1.hostfurl.com, ns2.hostfurl.com and ns3.hostfurl.com as name severs at the registrar level and recommends customers who manage their own domains on registrars do the same.

Hostfurl does not recommend customers use glue IP records for name servers or include an additional name server record, easily determined by the dig command. Nameserver records at the registrar level are only pointers to authoritative records and including glue records or the additional name server record means that Hostfurl cannot move servers around transparently without customer co-operation involving specific tasks and without Hostfurl adding specific tasks, resulting in unnecessary additional time.

2d. Free Admin Sub Domain

All hosting services are provided are provisioned with a free admin sub domain, which is non portable outside Hostfurl and so should only be used for admin and testing purposes.

2e. Demonstration Sample Sites

Demonstration sample sites are automatically made available on hosting service creation.

Further information is available from links to continue to develop using the sample site or the sample site can be easily replaced.

The Hostfurl forum should be considered useful to ask questions.

As a convenience and as an additional optional service, Hostfurl may make available private Git hosting and CI/CD services to allow CMS style editing of demonstration sites without further set up.

2f. Hostfurl Shell

Hosting accounts can use a limited Hostfurl shell to support updating hosting files through automated and manual means. Local edits can use rysnc to efficiently upload updates incrementally.

Hostfurl considers using the shell to send email with curl through authenticated SMTP a legitimate use. The Hostfurl shell has been prevented from being adapted to work as an open email relay and the shell is blocked from allowing a binary to insert emails into the MTA.

Each hosting account shell runs in its own isolated space and supports basic script and utility functionality but not long running jobs, cron launched jobs or processes that use excessive RAM.

2g. Email Filtering and Processing

There are three levels

  1. For email users, sieve script editing using ManageSieve server and webmail is available for user level filtering and processing
  2. An additional means for a user with user name admin@mydomain.com to add in domain wide filtering
  3. A means for other users to specify and so request domain wide filtering, but not action it

The admin@mydomain.com user can action domain wide filtering for domain mydomain.com. This user need not necessarily have any other admin permissions.

2h. Webforms to Email

Webforms to Email, when used properly, provides an easy way to lower communication friction with those you already know and have an expectation of participation.

An example is a club that organises events and requests members to volunteer with specific skills and availability.

While demonstrating contact/subscribe/unsubscribe demonstration forms in sample sites, the Webform to Email system should only be viewed as a quick convenience to obtain detailed specific answers in response to circulars sent out to members or subscribers who expect to receive such invitations. When specific information is requested, it is not ideal to expect free form answers from long communications that expect more than a simple yes/no answer, which is irritating. Instead, providing a link to a clearly guided form that can be filled in quickly is preferred.

Unsolicited forms are most likely spam from robots. Forms with short nonsense content are likely seeking to harvest personal email addresses to spam to.

If unsolicited forms are filled and do not appear to be robot generated, it is important to verify they are genuine before acting on them. For example, for a subscription request to a newsletter, confirm the request by email first. Keep in mind they may be seeking an email address to pass onto spam address list sellers.

Any unsolicited contact advertising a service or product should be ignored.

Hostfurl may use a privacy focused, non third party, non-interactive, post form submission challenge that is quickly solved by non robot browsers using proof-of-work and browser instrumentation.

Hostfurl may also refuse to pass on forms to emails based on characteristics of information filled in matching robot characteristics.

2i. Email Send Ratelimiting

Email send ratelimits are applied at smtp user level and domain level. Soft reject replies will be issued.

The current ‘Hostfurl Email Rate Limits’ is available from https://hostfurl.com/erl. Currently it is subject to change without notice.

The SMTP independent ‘sendmail` command is not available for customer shell use. Uploading a ‘sendmail’ binary will not work as it will have no access to the required subsystems in the shells runtime environment.

Authenticated SMTP may be used in the Hostfurl shell to send email and is subject to rate limits above.

2j. Hosting Service Upgrades and Downgrades

Upgrades and downgrades can be requested by raising a support ticket. Upgrades will result in an invoice to pay difference and downgrades will result in credit. Downgrades may require customers to reduce use of storage. Where an upgrade/downgrade cannot be performed on same physical server, a customer is expected to suspend updating and using their server to send email and to expect temporary soft rejection of incoming email for an agreed time.

Fees may apply in the future.

3. The Customer Agrees to Pay

The Customer agrees to pay to Hostfurl The Fees in respect of the Hostfurl services provided. The fees are required to be paid by The Customer to Hostfurl within 14 days of the dispatch of the invoice. Invoices will be sent electronically by E-Mail.

Hostfurl reserves the right to alter the amount and nature of The Fees. Hostfurl will give The Customer notice of any changes to The Fees electronically. The Customer will have fourteen (14) days’ notice of the changes to the Fees. If The Customer do not wish to continue to use the Hostfurl Network The Customer are required to notify us within that fourteen (14) days period of the same and Hostfurl will disconnect The Customer’s account. If The Customer does not respond we will assume that The Customer has accepted the revised Fees.

If The Customer does not pay The Fees within the specified period we reserve the right to charge The Customer interest at the rate of 15% per year accruable daily from the due date for payment until the date that the payment is received by Hostfurl.

Hostfurl also reserves the right to require The Customer to pay an administrative charge for late payments.

The Customer acknowledges that The Customer is responsible for all Fees incurred by anyone using The Customer’s account login or password regardless of whether or not The Customer has authorised them to do so. Accordingly we strongly advise that The Customer takes all appropriate action to ensure the absolute security of The Customer’s account login and password details If The Customer provides a credit card or direct debit authority, it will be debited upon renewal unless The Customer instructs otherwise. 14 days’ notice is required if The Customer does not want a payment to be charged against an existing credit card or direct debit authority.

4. Fees

Fees are payable in advance.

The Customer will be notified prior to the commencement of any billing period of the Fees payable for that period.

5. Content of Information

The Customer agrees to use the Hostfurl Network only in accordance with the Acceptable Usage Policy.

The Customer agrees to comply with all the reasonable directions and instructions of Hostfurl in relation to use of the Hostfurl Network.

The Customer agrees to observe all relevant laws in the State or Territory in which The Customer resides relating to the use of the Internet.

Subject to this agreement, Hostfurl recognises the customer’s wishes for privacy and does not purport to exercise control or supervision over the content of information accessed or provided via the Hostfurl Network. However, if Hostfurl for whatever reason becomes aware of a breach of the Acceptable Usage Policy then it reserves the right to immediately;

The Customer acknowledges that Hostfurl, under these circumstances, will have access to The Customers data, and whist generally Hostfurl will respect The Customers privacy, in very limited cases such as resource allocation or system checks Hostfurl will examine data content. The Customer agrees in those cases that Hostfurl will not be held liable by The Customer for any alleged breach of confidentiality or privacy.

6. Acceptable Usage

These Terms and Conditions include and incorporate the Hostfurl AUP available https://hostfurl/aup.

7. Disclaimer

Hostfurl will endeavour to provide the Hostfurl Service to The Customer to the best of its ability. However from time to time there will need to be proper maintenance of the Hostfurl Network and at some times Hostfurl may not be able to provide The Customer with the service. Hostfurl will endeavour to minimise down time and where possible schedule such down time at a time least likely to inconvenience The Customer. Due to these factors Hostfurl can give The Customer no warranty or guarantee in relation to the availability of the Hostfurl Services at all times. Similarly it gives no warranty or guarantee in relation to the performance features or compatibility of any co-operating electronic mail network or connected Internet service. If Hostfurl suspects The Customer is in breach of these Terms and Conditions Hostfurl reserves the right to access the customer’s data for the purposes of investigating breach of terms.

8. Indemnity

The Customers indemnifies Hostfurl and holds Hostfurl harmless against any damages arising from any claims brought by The Customer or any other person against Hostfurl from The Customers use of the Hostfurl Service, The Customers negligence or The Customers breach of this agreement. Except as provided by the contrary by Legislation The Customer acknowledges that Hostfurl is not under any liability to The Customer in respect of any loss or damage which The Customer may suffer from the provision of the Hostfurl Network or its inability to do so. In particular Hostfurl accepts no liability for any loss of business, personal discomfort or any other damages arising from or alleged to have arisen from the loss of or non-provision of services to The Customer or any third party. We specifically exclude any implied warranties from this Agreement. If by Legislation we are required to give a warranty as to services then The Customer agrees that our liability for any breach of such warranty is limited to

9. Protection of Data and Backups

Hostfurl distinguishes between ‘host data’ customers keep on their servers through hosting services, ‘server data’ such as server encryption keys and configuration, and ‘account data’ used for account administration and records. All three types of data are backed up encrypted off the servers they are on twice with at least one copy on a different site. Backups are made in the same region. Hence backups of servers in Europe reside encrypted on servers in Europe. There is two purposes for these backups.

  1. Allow data recovery if a server or its data is destroyed
  2. Under some circumstances and if timely, allow customers to request recovery of data.

None of this data is retained permanently. One week should be regarded as the limit for data retention.

Customer account data is retained unless a customer specifically request their customer account with its data is deleted. Some account data relevant to invoices and payment processing is retained.

Hostfurl advises that whilst it will use its best endeavours to preserve the integrity of The Customers data, it is NOT liable for any damage or loss caused by loss or damage to The Customers data. Hostfurl strongly advises The Customer that they should prepare and maintain independent backup files of all data provided or accessed under the Hostfurl Network.

10. Our Right of Termination

Hostfurl is entitled to immediately terminate this agreement without any requirement to notify The Customer in the event that;

In addition to our right of termination we can also without notice suspend The Customer’s account if The Customer’s account is overdue. If we then chose to reconnect the account – which we are not obliged to do – The Customer will be required to pay the necessary reconnection fee.

11. Refunds

Except for domain name purchases, full or partial refund is available within 14 days of payment.

After 14 days, all sales are final.

Except for domain names, a full refund is available for unused services.

Except for domain names, a partial refund may be available for well used service

Refund requests for already terminated accounts will not be accepted.

Where possible, refunds will be paid using the same method as the initial payment.

All credit redeemed from any FREE CREDIT promotion is non-refundable.

For domain names purchased through Hostfurl on your behalf that complete successfully, orders are final with no refund. Hostfurl is unable to obtain refunds for successfully completed domain name orders paid on your behalf.

12. Privacy

These Terms and Conditions include and incorporate the Hostfurl privacy policy available at https://hostfurl.com/privacy.

13. Credit Card Information

Hostfurl uses Stripe and PayPal for credit card processing. GoCardless is also offered.

14. Miscellaneous

If any goods and services tax or value added tax or any similar tax is imposed or arises as a result of this agreement then that is a cost that The Customer must pay in addition to The Fees.

The Customer acknowledges that this agreement cannot be assigned by The Customer to anyone else without consent from Hostfurl. However Hostfurl can assign its rights under this agreement without The Customers prior written consent. Any assignee to whom Hostfurl sells its rights will be required to notify The Customer if the same occurs.

Unless otherwise agreed the relevant law to apply to any dispute that arises between Hostfurl and The Customer is the Law of the State of Queensland, Australia

The Customer is deemed each time that they access the Hostfurl Network to have checked these conditions for any changes and Hostfurl strongly encourages The Customer to do so.

15. Complaints

If you have a complaint or issue with the service we are providing we urge you to contact us.

We will acknowledge your correspondence within 3 working days of its receipt, and will make all reasonable efforts to provide you with a response to your concerns within 7 working days. We will endeavour to resolve your complaint as soon as possible. In the event that you remain unsatisfied with our proposed resolution, please let us know. We can discuss the matter further if necessary and/or advise you of third party resolution options that may be available to you depending on the circumstances.

A quick way to notify a complaint is to put complaint in the subject at https://hostfurl.com/contact, provide further details in message and include an email address for follow up.

16. Cancellation Policy

All cancellation requests will be in writing by post or email, seven days prior to the due date of the service renewal.

Where possible, refunds will be paid using the same method as the initial payment.

17. SLA

Hostfurl offers a 99.9% uptime guarantee over 30 days via this Service Level Agreement based on the node availability.

This uptime guarantee ONLY applies to the node availability.

This SLA does not cover any outage due to server software, operating system, improper configuration, Denial of Service Attacks or the pause/suspension of your Hosting or DNS services.

Any outage caused by third party, including network, is not covered.

When applicable for credit, you will receive the agreed amount in credit to your Hostfurl account. This is non-refundable.

Hostfurl takes active steps to avoid outgoing IP addresses becoming listed on DNSBL lists and has plans for both avoidance and remedial action. If a DNSBL listing occurs then is not included or covered as an outage during the time a DNSBL.

18. Free Credit

The remaining credit expires in 365 days from the day of redemption. The credit is non-refundable. Can only be redeemed once per person. Our terms of service are subject to change. Any changes will be available on this page.
